Abstract
Constructive Total Loss is common to marine insurance and Colombian jurisdiction allocates space in its law to regulate it. Nevertheless, many at the Colombian insurance market relate this institution with other types of insurance, being unaware that Constructive Total Loss is a marine insurance creation.
The regulation by our local law is somehow comparable with the common principles of the figure, applicable under other jurisdictions with great maritime and insurance tradition, nonetheless, Colombian law requires for its application the fulfilment of some formalities, which makes its study relevant.
