Abstract
Although parts of the Antarctic Treaty Consultative Meeting 2009 considered the Antarctic bioprospecting was adequately regulated by existing Antarctic legislation, this article shows that there are legal issues regarding the definition of fundamental concepts and possible incompatibilities with basic principles of Antarctic Treaty, not yet resolved, so that there is legal clarity for bioprospecting activities in Antarctica.
