Abstract

This paper seeks to illustrate the effectiveness of remedial measures ordered by the Inter-American Human Rights Court. In the authors’ view, this is one of the situations which currently require a careful study and immediate actions of States, organs of the Inter-American System and civil society organizations. In particular, the authors seek to highlight some important issues, especially the notion of integral reparations (Chapter 1), the legal nature of the judgments of the Inter-American Court and the consequences of the absence of compliance of such remedial measures (Chapter 2), the actual compliance of the States in relation to remedial measures ordered by the Court HR (Chapter 3), and the different obstacles in the States’ compliance and unfilled criteria in some measures ordered by the Court HR (Chapter 4). Hence, the article deals with the question of whether the remedies ordered by the Court HR and the modalities for compliance really achieve their true aim: full compensation to victims of human rights’ violations. At the end, the authors discuss some
proposals, in order to help the achievement of such goal.
