Problema jurídico: ¿Hay vulneración de los derechos fundamentales como consecuencia de la decisión de la aseguradora fundada en la prescripción tomando como fecha de inicio para el cómputo la de estructuración y no la del conocimiento?
¿En el seguro de vida deudores, en los casos de incapacidad total y permanente, se entiende ocurrido el siniestro en la fecha de estructuración de la incapacidad establecida en la Certificación de la Junta de Calificación?
¿El cómputo del término de prescripción debe iniciarse desde la fecha de estructuración de la incapacidad, o desde la fecha en que queda en firme la certificación?
