Abstract
This paper deals with problems present upon insuring environmental damage by analyzing legal and practical situations in the Cuban context. An analysis of environmental damage as basic category to be able to tackle the topic that is the purpose of the study in made. In a punctual manner, a reference is made to the solution that some legal norm offer when demanding the mandatory subscription of environmental insurance policies, by proposing elements that have to be taken into account in making such provisión ans effective one.
