Abstract
The declaration of risk prior to taking out an insurance policy is a legal duty of the policyholder or insured in insurance contracts that is even more relevant in life and health insurance. But the pre-contractual declaration of risk becomes a shared duty insofar as it necessarily requires the diligent assistance of the insurance company with the presentation of a rigorous questionnaire and, if necessary, with the help of the policyholder's employees to complete the document. Both the malicious concealment of information by the policyholder and the negligence of the company in the presentation of a sufficient questionnaire and assistance in filling it out cause conflicts between the parties that are resolved by the courts of justice, which has given rise to a rich jurisprudence that is fundamental for interpreting the content and scope of the pre-contractual duty of conduct beetwen policyholder and insurer.
