Abstract
Due to the lack of clarity regarding when an insured event (loss or claim) occurs in liability insurance—as this requires expertise in both insurance and civil liability—there are serious difficulties in practically applying various insurance doctrines. We argue here that liability insurance, being a type of indemnity insurance (or 'insurance of damages'), will only have an insured event when there is damage, and we analyze the practical effects of asserting either interpretation, such as which policy is called upon to respond in cases of continuous or delayed damage.
