Abstract

This article presents the results of a reflection made under the international Human Rights law, the European and Inter-American human rights protection systems, and the Universal law, all in relation with any rights that may be considered a limitation of the sovereign power of states to define their migration policy. Also, it deals with the principle of equality and nondiscrimination of foreigners, the discretion of States to define their migration policies, and analyzes that this  principles may constitute a limitation to the sovereignty of states.
