Abstract

This article relates to “simplified agreements”, which are a special class of international agreement that clarify treaty frameworks, that is to say, main treaties. Many simplified agreements occur outside the control of the Congress or the Constitutional Court. Theoretically, they should contain no state obligations other than those contained in the main treaty. However, the President of the Republic has executed a number of “simplified agreements” that are not, and which in fact contain new obligations for the Colombian state. These have been entered into without any control. The thesis of this article is to look at the procedures by which the President has managed a mechanism to elude and evade constitutional controls and have affected the fundamentals that ought to underlie the Constitutional Democratic State of Colombia.
