Abstract
Le projet de Traité Constitutionnel du 18 juillet 2004, se veut consacrer les droits fondamentaux au coeur de la construction européenne tant sur le plan juridique que sur le plan des valeurs. Il se peut que cette volonté affichée se révèle être un voeu pieux. La complexité et l’ambiguité caractérisent ce texte.
C’est pourtant le résultat d’une lente évolution, la construction européenne ayant noué des rapports très tôt avec la matière des droits fondamentaux. L’objet de cet article est de rendre compte de cette évolution, constante et complexe.
