Abstract

Author explains the diverse tools of interpretation, both special and general, can be applied to the international human rights law. Pro homine principle is elevated as a fundamental tool for the correct application of these norms. Nevertheless, this can not become a wild card to extend the commitments of the states parties in the international treaties. Therefore, and as a particular case, the listings of the rights included in the Articles 4.2 of the International Covenant on Civil and Political Rights and 27.2 of the American Convention On Human Rights, must be taken in a restricted way.
