Abstract
The object and purpose of this action is to offer him to every person, natural or legal, and even to the public servants, the possibility to respond before the judicial authority to require the execution or the fulfillment of the duty that arises of the law or of the administrative act and that is omitted for the authority, or the individual when assumes this character. In this manner, it referred action is directed to try the force and material effectiveness of the laws and of the administrative acts, which involves the concreteness of principles medulares of the Social State of Right, that tend to assure the force of a just economic, social, and legal order. The author presents this figure, compared with it adopted in 2004 inside the Code Procesal Constitutional of Perú, whose object is to order that the official or unwilling public authority give fulfillment to a legal norm or execute an administrative act sign; or be pronounced explicitly when the legal norms order him to emit an administrative resolution or to dictate a regulation.
