Abstract
En ce qui concerne les investissements internationaux, les flux des échanges entre les pays formant la future Z.L.E.A. constituent 44,9% des investissements internationaux du monde, ce qui exige des règles juridiques claires sur la matière ainsi qu’un système de règlement des différends répondant à la nouvelle réalité économique. En effet, la Zone de Libre Echange des Amériques coexistera avec les règles de l’O.M.C. et avec d’autres accords d’intégration économique infra-régionaux, bilatéraux ou multilatéraux, possédant ses propres systèmes de règlement des différends. C’est pourquoi, il faudra se demander comment le système de règlement des différends de la Z.L.E.A. va fonctionner et s’articuler avec celles-ci, et analyser, si les États et les investisseurs pourraient manœuvrier parmi les divers forums existants avec le but de choisir celui qui est le plus favorable pour eux (forum shopping).
