Abstract

Throughout this study we make an approach to the structure of the SAS shares, given their representation, transferability, restrictions on itself and its different types, based on its essential incardination in capital of the society. We have emphasized this comparative analysis of Colombian Law, mainly with Spanish and European law, German and Italian especially, to clear horizons and problems that the legal norms of the shares can arise in practice.
The SAS system leaves certain areas in regulatory semi-darkness. We want this study to provide reflections and interpretations that can help to find solutions to those problems.
