Abstract

El presente artículo expone el creciente incumplimiento de las sentencias de la Corte Constitucional colombiana después de un periodo de dieciséis años durante el cual ha buscado solidificar la noción de derechos fundamentales a partir de su protección material. El escrito presenta un resumen de la posición de la Corte con relación al incumplimiento de sus sentencias y al papel de los jueces de tutela como garantes principales de la efectividad de las protecciones constitucionales. De la misma manera, analiza tres tipos de incumplimientos injustificables de sentencias de la Corte Constitucional, así como un tipo de incumplimiento justificado de fallos de tutela. Por último, aborda de manera descriptiva y analítica las soluciones jurídicas que ha asumido la Corte Constitucional para velar por el cumplimiento de sus fallos.
