Abstract

Una definición de precios de transferencia, debe tener un carácter neutro en virtud que éstos puedan ser utilizados tanto para proteger los intereses de las autoridades tributarias nacionales, como para impedir la doble imposición sobre las empresas involucradas y permitir a éstas evaluar las relaciones económicas naturales derivadas de la vinculación. Colombia desde el 2004 ha adoptado como normas básicas del Régimen de precios de transferencia para efectos del impuesto sobre la renta el criterio de vinculación y el principio de plena competencia, esto garantiza tanto para el contribuyente como para la administración unas pautas claras iniciales, de raigambre mundial, para la aplicación del régimen de precios de transferencia de conformidad con las condiciones de mercado.
