Abstract

A lo largo de todo el pensamiento de la escolástica se siguió manteniendo, de forma más o menos matizada, el origen trascendente y divino del derecho positivo, que no es más que el reflejo y la manifestación de lo que podríamos denominar la ley natural. Esto hizo que el derecho no contara con su propio criterio de validez, sino que su criterio de validez y, en definitiva, de existencia como derecho, fuera un criterio moral consistente en la adecuación de éste a la ley natural. El problema de la articulación entre lo ético y lo jurídico en santo TOMÁS se encuentra, en consecuencia, en el centro de la reflexión filosófica sobre la ley natural. Se advierte, por tanto, la necesidad de estudiar y desarrollar este tema dentro del límite filosófico, sin por ello olvidar su punto de partida teológico.
