Abstract

In this document, the author carries out a lesion study, starting with its historical antecedents until its conceptualization of doctrine, configurative elements and legal nature. 

Subsequently, the author analyses the norms of peruvian Civil Code that the institution has taken, examining its presuppositions, contractual scope, cases in wich there are no proceedings, legal sanctions, tittles and terms.

Finally, he makes a proposition in wich he reformulate the orientation of the legislation with regard to the actions on the lesion, proposing to opt for the readjustment of the prestacionales values over that of the rescissory action.
