Abstract
La presente investigación, pretende demostrar, en el régimen constitucional colombiano, la armonía entre la descentralización y el Estado unitario.
Corresponde a la ley una delimitación expresa de las facultades de las entidades descentralizadas, y como enseña la Corte Constitucional (sentencia C-478/92):
“… De lo que se trata es de armonizar los distintos intereses y no
simplemente de delimitarlos y separarlos…”. “…Las competencias
que se ejercen en los distintos niveles territoriales no son
excluyentes…”.
Lo anterior no implica fraccionamiento de la soberanía por ser ésta unitiva e indivisible (ROUSSAU, Corte Constitucional, sentencia C-539/95).
La descentralización es una. Es impropio hablar de grados o generaciones de la misma, o confundirla con la desconcentración (artículo 209 CP), la cual es una línea intermedia entre la centralización y la descentralización, figura que en la práctica predomina en Colombia.
Se concluye que una recta aplicación de la descentralización, contribuye a la paz social.
