Abstract

On December 7, 2001 a new Spanish Trademark Act was enacted. One of
the main purposes of the reform is to adapt the Spanish Law to the European Community Law and the international treaties. The article analyses the most relevant legal aspects of the Act, like the concept of trade mark, the risk of confusion and association and the exhaustion of trade marks. It also presents the key factors of the Spanish Trade Mark Law and includes a selected bibliography and a list of useful web pages.
