This article explains the procedures against judgments uttered under unconstitutional laws, court congestion and conflicting interpretations between the jurisdictions. It presents one of the results of Natalia Bernal-Cano´s thesis Le contrôle de constitutionnalité de la loi sur recours d'un individu en Allemagne, Belgique et Colombie. It’s important to note Natalia Bernal-Cano's arguments have been used to adopt, in order Colombian law, the protection of fundamental rights, violated or threatened by the unconstitutional laws application opposed to the Constitution. The arguments of the thesis, used in this scientific contribution, propose a single model of constitutional justice in nature mixed.
