Abstract

This article is the result of a doctoral dissertation thesis research project entitled “El municipio colombiano y sus posibilidades de desarrollo económico y social” (The Colombian municipality and its possibilities of economic and social development) carried out within the Public Law Studies Group, which takes into account the national context and which concludes that remittances end up strengthening municipalities. The State of Colombia recognizes inalienable rights of people and protects family as a pivotal society institution; therefore the analysis of mechanisms set out in the legal rules to guarantee the rights of people that decide to freely leave the national territory as well as of those entering either transitorily or permanently is made. The change of paradigm related to migrations is presented to the extent that though people movement between borders has always been evidenced, the issue gets to be more important in the context of globalization. In the first part of the article a presentation on the steps to be taken as to harmonization and integration of actions versus migrations is made, and in the second part, a revision on remittances, a topic of great interest and focus in studies on migrations is presented; this later approach is made in a subsidiary fashion because it is considered that the focus has to exist first on the protection of persons, and later on taking advantage of the opportunities generated by remittances regarding migrations and their contribution to the strengthening of municipalities.
