Abstract

Analyzing social life, ULRICH BECK came to the conclusion that the contemporary man “lives” among risks that no longer move in the plane of the unexpected [unforeseen], because each time these risks surge more and more from situa- tions created by the forms of cohabitation.

From this notion, ALLAN MICHAEL LAVELL introduced a conceptual turn and supported on his principles he preferred focusing in catastrophes [disasters], among which he included the claims history of the motor vehicles.

Treatment global insurance of this risk, with socialized options to transfer, goes back to 1919, sometimes opt for civil liability and other opt for personal accident insurance policies, as in the case of Colombia. But even here it is possible to question some operational ways that deny the coactive ingredients towards those responsibles that whether fraudulently or culpably have incurred in damages or that, taking the easy way, choose not to punish (that who makes the fault must pay) those who are responsible.

Hence we are inclined to return to the mandatory expedition of the SOAT (compulsory insurance policy for traffic accidents) for every insurer that trade automobile insurance policies, while advocating the obligation to demand by the repetition action way to whom have had attempted against life and personal integrity to passengers and pedestrians and also advocating for an end to the insurance laxity of the patrimonial cover without it affecting the damage victim, which is complemented by a preactive risk administration policy in drivers by the stipulation of guarantees, with a previous warning that its violation doesn’t become a boomerang against the affected ones, which warrants a legal amend- ment to get the visualization of a multi-risk insurance policy focused on the SOAT with a unified term period.
