Abstract

This paper analyzes the figure of gross negligence in insurance law and particularly in civil liability insurance where it takes on special importance because the cause that motivates the insured to subscribe is the protection of their patrimony due to their reckless conduct. It is based on the concept of fault of the civil code and its graduation in order to establish if the treatment used in this area of ​​law corresponds to that of the commercial law of insurance. Once the term gross negligence has been defined in insurance law, its material delimitation is established in the contract, defining whether gross negligence is in principle covered or excluded, and whether an express agreement is required in one way or another. Finally, the idea of ​​replacing the generic concept of gross negligence with express and clear events that fulfill a preventive task and provide clarity to the judge when resolving a procedural discussion is proposed.
