Abstract

The essential function of insurance lies in the fact that insurance is a mechanism that seeks to eliminate the risks of modern life or at least to reduce them. This is done by transferring the risks from the legal and financial sphere of the insured to the legal and financial sphere of the insurer.

But this transfer cannot be done without certain safeguards inherent to insurance technic, otherwise insurance, instead of fulfilling a social function, would become a gamble or bet, and the insurer a speculator, putting the mutuality of insured parties at risk by assuming risks beyond its technical parameters. 

The insurer assumes the risks, but within the limits of the insurance contract in which he makes a selection of the risk within pre-established parameters, and a work of individualization of the risk and its delimitation by means of the clauses of the contract, which may, in turn, respond to legal delimitations.

Once the risk has been properly delimited and its technical bases have been met, insurance becomes a basic instrument for the process of production and distribution of goods and profits. It also ensures social equilibrium by eliminating or mitigating the fear of misfortune and promising coverage.

On this basis, insurance fulfils various economic and social functions, but it is worth considering whether the scope of these functions is sufficient in the post-modern era, and even more so in the current era where human beings are increasingly dependent on insurance.

On this basis, insurance fulfils various economic and social functions, but it is worth considering whether the scope of these functions is sufficient in the post-modern era, and even more so in the current era when humanity has been hit by a pandemic of unique dimensions and scope unknown to our generations.

Does insurance today have a new social dimension and does it - or should it - fulfil a greater social function?

This article will begin the debate on this question.
