Abstract
Several regional and globalization processes have arisen in recent years and have produced a real change in Foreign Investment Policies within developing countries. In generally, because the necessity of attracting foreign inflows and its respective advantages. This is the reason why Colombia, in the decade of the 90’s, implemented important constitutional and legislative amendments and started the negotiation of several International Investment Agreements –IIAs–. Aware of this reality the present paper, intends to analyze the main Colombian and Canadian provisions in order to establish the key issues to negotiate and ratify a Bilateral Investment Treaty between the Parties, that dynamize Colombian economy through the commercial presence in such an important country like Canada, so that the conditions to Canadian investors in Colombia significantly improve.
