Abstract
Por más de cuatrocientos años ha existido un con-flicto entre los Gobiernos y los indígenas en Colombia por las tierras de los resguardos y que aún hoy en día sigue vigente. Este artículo intentará demostrar, por medio de un estudio comparativo realizado dentro de lo que se denomina los ángulos superior e inferior, las diferencias y similitudes entre los intereses y las creencias que estos dos actores tienen sobre estas tierras. Las discusiones académicas que se mencionan en este estudio revelan que no solo hay una falta de consenso entre los autores que estudian este tema, sino que, a su vez, demuestran que hay una brecha entre los principios establecidos en la ley y el contexto real que sigue prolongando este conflicto.
