Abstract
From the historical perspective and by means of a qualitative-descriptive analysis a revision becomes of the functions that consecrates the Law for defending the curator-promoter of family minors today called; interlacing the functions that from Law 83 of 1946 him have been assigned. In the teleo- logical paradigm of interpretation, the modern right tends to be integral and universal in the protection of the childhood and the defense of the institution of the family.
From the revision of the functions a concept of the family defender is created, who has not been expressed in the Law; a classification of the family defender is obtained and his is determined that to drive as justice administrator and as conciliator being tends to confuse.
