Abstract

En este trabajo el autor, bajo la teoría microeconómica del productor, analiza los principios constitucionales de progresividad en la cobertura y sostenibilidad financiera de la seguridad social en materia pensional. El autor, valiéndose del carácter dual del problema del productor, muestra cómo el Estado, para maximizar el bienestar de sus asociados, debe enfrentarse a su restricción presupuestal. A continuación analiza el principio de progresividad en la cobertura, mostrando los problemas actuales que se presentan con la definición constitucional. De igual manera analiza a la luz del modelo de JIMENO (2004) el principio de sostenibilidad financiera mostrando su carácter eminentemente subjetivo. Posteriormente, ilustra cómo estos dos principios interactúan al interior del sistema, definiendo normativamente su alcance económico; y cómo los derechos adquiridos, los regímenes de transición y las meras expectativas deben ser informados por estos principios. Finalmente se ofrecen algunas conclusiones.
