Abstract

In order to avoid the malfunction of Public Administration and to have an efficient form of organization of the Executive Branch, the Colombian Congress enacted in 1968 the so called estatutos orgánicos or basic rules that lasted until 1984. In that year, the constitutional jurisprudence pointed out that these rules were no more applicable by means of compel the lawmakers to determine the structure of Public Administration and to create Public Institutions either centralized or decentralized in the Executive Branch.

The consequence of this decision was gathered in the 1991 Colombian Constitution adopted a new regime of Public Administration disorganized that means that our country has lost in this particular item at least 40 years of development.

It is almost impossible to determine the size of the Colombian State due to the constant growing of Public Institutions that makes controlling and policing really hard. The chaos that tried to be solved between 1958 and 1968, especially with the Estatuto Orgánico in order to organize a Code, was again destroyed and buried by its repeal and then by the New Constitution, bringing back the chaos and the menace to the State because of the high costs of this multiplicity of Public Institutions.

Investment in social programs of the Colombian Government will be no possible if this problem continue unsolved.
