Abstract

This article analyzes the reaches of the called ordinary faculties
that the President of the Republic of Colombia has for the process of
restructuration of national public administration, according to the
article 189-16 of the Constitution and the article 54 of the law 489 of
1998. In the first part it will be exposed the juridical reasons of whose
consider that these faculties let to the president performs a regulation
function quite wide until the point that he can modify by decree the
legislation. In the second part, it will be exposed the juridical
arguments of those who consider that these faculties, according with
the constitutional and legal mandate, arent wide and for the same
reasons, there are many issues what only can be treated by legislature.
