Abstract
There is a widely held narrative about the categorization of intellectual property as a type of private property. This understanding of intellectual property, which has multiple historical and economic explanations, has also been instrumentalized as a platform for growth for the global intellectual property system.
Within this context, we find two high court rulings, in the United States and Colombia, that are not entirely consistent with the categorization of this protection system as a type of private property. The arguments contained in these two judicial decisions (the ruling of the United States Supreme Court in the case of Oil States Energy Services, LLC v. Greene’s Energy Group, LLC, et al., and ruling C-334 of 1993 of the Constitutional Court of Colombia) have raised questions for us regarding the aforementioned category. We believe that these two court decisions reveal a deep tension regarding the nature of intellectual property that is not limited to academic debate.
