Abstract

This article is the second product of the theoretical framework creation process on constitutional actions and political minorities, a project that is being carried out within the investigation lines on constitution and society, of the Universidad Javeriana Law School Public Law research centre.

Thus the reader will find in this writing a general characterization on the legal constitutional recourses in Europe, identifying the subjects that might file such recourse, its types, its effects and its consequences. On the other hand, a summary is made as to the constitutional recourses filed by the parliamentary minority in the Spanish case, in order to clarify both its legal framework and its practical development in that country.
