Civis Mundi Sum: un llamado por la validez universal de los derechos humanos

Resumen
Los derechos humanos son el resultado de una búsqueda por crear un sistema en el que la protección jurídica al individuo sea en función de su calidad de ser humano. De allí que el presente artículo, fruto de una reflexión teórica, tenga como objetivo comprobar la universalidad de estas garantías, en virtud a cinco argumentos: (I) los derechos humanos son una expresión de una moralidad aplicable a toda persona por el hecho de ser agentes morales, (II) se considera a los derechos humanos como principios debido a su indeterminación, lo cual permite su aplicación en contextos diferentes, (III) los derechos humanos no pertenecen de manera exclusiva a una civilización, su abstracción les permite un diálogo e interacción con diversas culturas, (IV) los derechos humanos cuentan con la capacidad de ser extraterritoriales, con lo cual se amplía el concepto de jurisdicción y (V) existe una importante tendencia internacional que afirma que los derechos humanos son normas de ius cogens, por lo cual son normas vinculantes para todos los estados. La conclusión de este artículo es que los derechos humanos aseguran unas garantías al individuo, independiente de su nacionalidad, lugar o tiempo de protección, toda vez que su fundamento es la condición de persona o ciudadano del mundo.
