Abstract
Este artículo describe la situación de salud de los niños y las niñas de uno a cuatro años en
Colombia y la presencia de disparidades, para lo cual se utiliza como trazador las Enfermedades
Respiratorias Agudas (ERA). En segundo lugar, explica los determinantes sociales de las ERA
y la conexión existente entre éstos, la reglamentación legal sobre el derecho a la salud, y el
grado de materialización de este derecho. Por último, analiza el papel de la política social en la
materialización de los derechos de los niños y la contradicción existente entre el marco normativo
y la garantía efectiva de sus derechos, que en muchos casos sólo se genera a partir de la tutela,
subvirtiendo con ello el orden constitucional e invalidando sus principios y valores.
