Abstract

This article examines the modification of the product liability regime as defined by the European Parliament in the Resolution of 12/03/2024 repealing Directive 85/374/EEC, as well as Regulation 2023/988 on General Product Safety. The main elements of the new regime are analyzed, including the regulatory objectives, the regulated products, the persons subject to the new regulations and the beneficiaries of the new rules. The liability rules for defective products are also explored. In addition, the article analyzes the impact of the new regime on the insurance market and on the Colombian legal system. It addresses issues such as the delimitation of the machinery breakdown warranty arising from contractual liability, as interpreted by the Colombian Supreme Court of Justice in Ruling SC4066-2020 of October 26, 2020. The issue of the evidence to be provided by the victim for defective products in the consumer regime is also studied. Through this analysis, we seek to provide a comprehensive understanding of the changes and challenges brought by the implementation of the new defective products regime.
